Ainslie Bullion Terms of Trade

  1. a. Ainslie Bullion (AB) will accept orders from a customer (you or your) for Metal via the internet. Deposit and freight payments made through the store are capped at $AU10,000 per order per customer.
    b. AB will accept orders from a customer for Metal via the phone or in person.
  2. By placing an order with AB you are taken to have accepted the Terms & Conditions as set out hereafter.
  3. For Internet Orders: The order will be made upon you paying 10% of the price (up to a maximum of $AU10,000) by credit card payment immediately (Credit Card purchases incur no transactions surcharge for Visa and Master Card- bullion deposit only). Should the customer fail to pay the total balance of the purchase price within the agreed time frame as set out below, the customer will be in default of this agreement and the deposit will be forfeited.
  4. For Telephone Orders: Should the customer fail to pay the total balance of the purchase price within the agreed time frame as set out below, the customer will be in default of this agreement and AB reserves the right to reprice the invoice.
  5. You agree to pay the balance of the purchase price by 5:00pm (AEST) on the following Business day, by one of the following methods:

    • Cash payment into our bank account or in person at our store;
    • Bank cheque into our bank account (noting we will wait for this to clear);
    • E.F.T payment – Please be aware of your transfer limits. If you are unsure contact your bank prior to placing the order. If you make a purchase over your daily transfer limit, your deposit will be forfeited unless you can make other arrangements with your bank prior to the 5:00pm (AEST)deadline;
    • By credit card payment (Credit Card transactions must be Visa and MasterCard only and will incur a 1.5% surcharge).  
    • By debit card payment (Debit Card transactions will incur a 0.5% surcharge).
    • By BPay
    • Personal cheques paid into our bank account (noting we will wait for these to clear): Should a personal cheque be dishonoured at any time, the deposit will be forfeited

  6. AB bank details are as follows:

    • The customer is required to quote, as part of the bank deposit, the invoice number provided by AB. This requirement is necessary to identify the customers payment;
    • Cheques(bank cheques & personal cheques): the order will not be processed until the funds are cleared through the banking system (this process can take up to 7 days)

  7. Financial Transactions

    The currency for all transactions will be in Australian Dollars (AUD). AB reserves the right to refuse any orders at its own discretion without giving reason. Should a transaction be detected as a fraud at a later date, AB reserves the right to commence legal action.

  8. Customer Identification Requirements


    Section A 1
    In order for us to 'know our clients' it is mandatory that all clients who "Open an Ainslie Bullion Storage Account" with us provide identification documents in the form of either a Certified Copy of their Driver's Licence or a Certified Copy of their Passport to meet Australian Transaction Reports and Analysis Centre (AUSTRAC) requirements. Regardless of the size or value of the Bullion purchase, all clients placing orders with AB must adhere to the following terms as stated below.     Section A2
    For a transaction THAT IS TO BE DELIVERED, a certified copy of one of the following documents is required; current passport (Australian or International) or Australian Driver Licence or Proof of Age Card with photograph issued by your State or Territory or identification card issued to a public employee or identification card issued to a student at a tertiary education institution.

    Section B
    A certified copy of one of the following documents is required; ATM card issued by an Australian bank (front and back copy) or Medicare card or Council rate notices or telephone account document or utilities account document or foreign Driver Licence (front and back copy) or Australian Citizenship Certificate or Birth Certificate or a notice issued by the Australian Taxation Office within the preceding twelve (12) months.

    Companies, Trusts, Super Funds etc
    For Business organisations the following certified documents are required in addition to the above mentioned documentation:

    • Copy of Business/Company Registration;
    • Identification documents of the authorised person acting for the Business/Company;
    • Authority to act as the authorised person for the Business/Company on the letterhead.
      Please note that this is a one-off legislative requirement. Once the certified copies of the documents are given to us, we will not ask again for future purchases. All documents given to us must show the same name as that of the account holder. For purposes of verification, we accept certified copies of documents only from these occupations: Justice of the Peace; Legal practitioner (Lawyer/Solicitor); Commission of Affidavits; Commissioner of Declarations; Judge of the Court; Magistrate; Notary Public. All documents must be in English. Clients can post their documents to us. Faxed copies are not allowed. We will not dispatch any items that have been paid for unless we receive a certified copy of the above mentioned documents. Payments made for purchases cannot be cancelled or refunded if you cannot provide us with the necessary certified documents.


    A certified copy of a current driver's licence must be sent to us before your order will be delivered. Orders picked up in store will only be released to the credit card holder with a current drivers licence or similar official form of ID.

  9. Exchange/Money-Back Policy/Changes

    At AB you can be guaranteed of the quality of the gold/silver bullion products that we sell. We guarantee all our products (Precious Metals) are what it is supposed to be (Gold 9999 fineness, Silver 999+ fineness - except for some recognised coins eg: Krugerrands and 50c rounds). We offer full money back guarantee if the products that we sell are not what it is supposed to be.
    If you have been sent an item which is not the one that you have purchased, that is, we send you the wrong item, we can send you the right item or refund your money back (refunds can take up to 10 business days to show up on your bank account or on your credit card), provided the following steps are followed:
    • You must contact us at the earliest opportunity via e-mail or phone before sending your item back. AB will provide you with instructions on how to ship your item back after you contact us. We are not responsible if your item gets lost during shipment. Therefore, we recommend that you take out insurance as we do not provide return transit insurance. It is your responsibility to ensure that the items are adequately packaged so that they are not damaged during return transit.
    • We will not ship any exchanged item to you until your item along with its purchase receipt is returned to us.
      Changing your mind about the purchase is not a legitimate reason for an exchange. We are more than happy to guide you prior to placing an order. When in doubt, please contact us via e-mail or phone. We will NOT accept any returns or exchanges for the following reasons:
      • You have changed your mind;
      • You are having financial problems;
      • You have found a different item which you prefer;
      • You have found the same item at a lower price elsewhere; and
      • You did not read your Terms & Conditions and exchange/money back policy and did not know you could not return your purchase.
    • Your order is to be considered final, but late changes may be possible. This will be at the sole discretion of Ainslie Bullion. An Order Amendment fee of $95 will be charged at the discretion of Ainslie Bullion.

  10. Shipping and Pickup information

    We will advise you when your Bullion is available for delivery. The cost of shipping including insurance will be automatically calculated during check-out for website orders.

    Your order will be shipped once your payments have been received & your funds are clear. You will be advised its consignment note number and website where you can track your order. Your purchase order will be delivered except in cases where the address supplied is incorrect, illegible, incomplete or if the client is away or has moved, in which case you will be liable. AB is not liable under any circumstances if you have nominated someone else to collect the package on your behalf or someone else collects it without your authorisation or using fake identity or the address is a non-residential address and is signed by a third party. AB will not accept any liability if you have instructed the particular carrier to leave the package for you without the need for a signature

    Each purchase order can be insured for up to $50,000 only. For example, if your purchase order is $50,001 we would ship it in two different packages as each package can be insured only up to $50,000.

    We may at our discretion change the shipping method, if we find that the area to which we are to ship is considered a high risk. In such cases we may charge the client an additional shipping fee to ship the items safely and securely.

    If you elect to have your purchases shipped to Reserve Vault (RV) this service is provided free of charge.  AB will deliver your goods to RV who will receipt it together with an AB representative.  It will be held in a secure area until you come to collect it and place it in your storage unit or RV will do so for RV Custodial Clients.  AB will notify you by email once it is at RV and ready for you to make your appointment.
    We will advise you when your Bullion is available for pickup. We will hold your purchase for up to 30 days from the date of purchase without charge. Charges will apply if you do not pick up your purchase within 30 days. We will not be liable for purchases not picked up after 90 days.

  11. Delivery Period for Bullion

    Orders are shipped within five (5) Business days of clear funds being in our Bank Account. Larger orders may take up to ten (10) days. While AB strives to dispatch all orders quickly, this may not be possible owing to a high demand for Bullion. AB will not be liable for any claims associated with late deliveries.

  12. Supply Interrupted

    If AB is directly or indirectly prevented from making supply or otherwise performing an obligation, by reason of events beyond its reasonable control (including any force majeure event including restricted availability of input products of required quality, act of God, fire, earthquake, flood, lightning strikes, natural disaster, mechanical or electrical failure, industrial action or dispute, lockout, epidemic, war or act of war (whether declared or not), terrorism, revolution, malicious damage, sabotage, civil unrest or disturbance or action or inaction of any foreign or domestic government or third party), its obligations are suspended while it is prevented from doing so. AB will use all reasonable endeavours to terminate the event giving rise to delay but that will not include the settling of an industrial dispute on disadvantageous terms. Upon termination of the event AB must resume the performance of its obligations under this contract at the earliest date reasonable possible.

    We will not be responsible for any loss or damage incurred by you where we do not receive your instructions or where any dealing or proposed dealing is interrupted, unable to be completed or unable to take place due to the failure of any telephone, computer, other electronic or technological device.

  13. GST

    • In this clause the following definitions apply;

      • GST has the same meaning as in the GST Act
      • GST Act means the A New Tax System (Goods and Services Tax) Act 1999
      • Taxable Supply has the same meaning as in the GST Act
      • Tax Invoice has the same meaning as in the GST Act

    • The consideration payable by the client has been fixed without regard to the impact of GST
    • If GST is or becomes payable on a Taxable Supply made under or in connection with this document, the party providing consideration for that Taxable Supply (recipient) must pay an additional amount equal to the GST Payable on the Taxable Supply.
    • The additional amount payable must be paid at the same time as the consideration for the Taxable supply or on the date on which the party making the supply delivers a Tax Invoice (whichever is later).
  14. Ainslie Bullion “Allocated” Storage Account

    AB offers a secure storage service for its clients of allocated gold and silver for an annual fee.  The service is provided only when clients transact (buy or sell) $10,000 or more in bullion.  The client will be provided with a storage account number and Certificate of Holding and the metal will be held within AB’s storage area of Reserve Vault in Brisbane.  The client’s holding will be as purchased and stored separately.  Ainslie Bullion does not take All Risks insurance on goods within this service.  Reserve Vault is an international standard high security facility.  Annual fees will be invoiced on 1 June each year.  The first year’s payment will be whatever proportion of the year to to date remains.  The fee is subject to change with appropriate notice.

    Payments not made within 1 month of the invoice date will incur a late payment fee of 10% of the total, applied monthly.

    In entering into an Allocated Storage Account the client hereby provides a lien over their goods in favour of AB for any unpaid fees should payment not be received after AB making reasonable attempts to procure ordinary payment from the client and after 3 months of non payment.

    You must notify us promptly and in writing of any change to your name, address, email and any other contact details.

    We will not accept any changes unless they are given to us in writing and signed by the person to whom those details relate.

    If you do not do so, we may be unable to contact you and this may result in the above fees or offsets being applied to unpaid accounts

  15. Ainslie Bullion “Unallocated” Storage Account

    AB offers a secure storage account service for its clients of unallocated gold and silver on transactions (buy or sell) of $10,000 or more.  An unallocated account is a share in a pool of bullion held by AB securely in Reserve Vault. Gold may be in a variety of bullion forms whereas silver is generally stored in 12-15kg block of which the client has a share. The client will be provided with a storage account number and Certificate of Holding and the metal will be held within AB’s storage area of Reserve Vault in Brisbane.  Ainslie Bullion does not take All Risks insurance on goods within this service.  Reserve Vault is an international standard high security facility.  There is no fee for gold and an entry fee only for silver.  All subsequent transactions must meet the $10,000 threshold.  The fee is subject to change with appropriate notice.  Should the client sell part or all of their holding, the price will be per the normal buy back price at that time for gold or silver blocks.  Should the client wish to take delivery of physical metal an additional small barring fee will apply to silver bullion (generally not gold) plus any handling and freight fees if appropriate.

    You must notify us promptly and in writing of any change to your name, address, email and any other contact details.

    We will not accept any changes unless they are given to us in writing and signed by the person to whom those details relate.

  16. Privacy Policy

    AB is committed to protecting your personal information in accordance with the Australian National Privacy Principles set out in the Privacy Act 1988.

    • Contact information from our online forms is used to obtain accurate shipping information to ship orders to the client. The client's contact information is also used to send AB sales material and for contact with the client during the course of the transaction. Financial information collected during the online shopping process is used to bill the client for our products and services. We do not disclose our clients' details or credit card information to any outside parties unless required to do so by Australian law.
    • All e-mail or other correspondence received from our website visitors is treated in strict confidence. We only use the information supplied by our client for the purpose of responding to the clients' questions. We will not sell or otherwise disclose such information including e-mail addresses to any external parties.
    • AB will only disclose your information to external persons or bodies as permitted by the Privacy Act 1988, including in the following circumstances:
      • Where you consent to the disclosure;
      • In the case of information collected through your application for AUSTRAC identification requirements;
      • To comply with all reporting requirements in order to detect, prevent and report money laundering activities;
      • To our contractors so that we can complete a transaction on your behalf or provide you with a service that you have requested;
      • Where required by law such as under a subpoena issued by a court;
      • For law enforcement purposes for which the information was collected.
    • CCTV Recording
      • You acknowledge and agree that
        • CCTV may be recorded within the AB office and stored for such period as we may determine for the purposes of security surveillance
        • 2. we may disclose any CCTV Recording arising from an order of a court or other judicial or administrative body, statutory notice or demand, or request made by any police officer or other officer of or representing Australia or a State or Territory, where it is required or allowed by law or where you have otherwise consented.

  17. Website Security Policy

    AB does not take security lightly. We are extremely serious about protecting your details whilst shopping online, and for this reason payments processed online are done so using the highest level of security reasonably available to us. All information you provide during the ordering process is encrypted for your protection. The AB site has security measures in place to prevent the loss, misuse and alteration of the information under our control. The page where you enter your credit card information goes directly to our secure server. Every keystroke you make is encrypted from you connection through to our secure server. Your information is also protected by AB's Privacy Policy. All information received from you is treated in strict confidence.

    In the event of Incorrect Data being downloaded to the website and purchases made under these circumstances may result in orders being cancelled and deposit returned.

  18. Spam Act 2003

    AB complies with the Australian Governments Spam Act 2003 and the guidelines for business in relation to the contents of commercial electronic messages. AB only send e-mail advertising with each addressee's consent, includes its address and contact and contact details in every e-mail promotion and ensures the inclusion of a functional unsubscribe facility.

  19. Information and Links to Other Websites

    The AB website may contain information, articles or links to or from third party websites. These articles and linked websites are not under the control of AB and AB is not responsible for the content of any linked website or any hyperlinked website or article information sourced from a website. The information contained on the website is given in good faith but no representation or warranty, express or implied, is made that such information is accurate or complete and it should not be relied upon as such. AB provides these articles and hyperlinks for your convenience only and the inclusion of any article or link does not imply any endorsement of the article or linked website by AB. Any article or link provided to any such website is used entirely at your own risk.

  20. Financial Disclaimer

AB does not accept any liability for any investment decisions made on the basis of the information on our website or gleaned from discussions with our staff. AB and its staff do not give investment advice and no converstaion should be construed as such.   23. Customer Service Policy

    Ainslie Bullion is committed to providing exceptional customer service and quality products. We endeavour to make sure that all products listed on our website are currently in stock and pricing is true and correct. Standard delivery timeframes are between 3-10 business days; in the event that an ordered item is not available or we are unable to fulfill your order we will notify you within 2 business days to arrange an agreeable alternative item, a backorder or a full refund.

  24. Security Policy

    When purchasing from Ainslie Bullion your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology.128-bit SSL encryption is approximated to take at least one trillion years to break, and is the industry standard.   25. General

    • AB reserves the right to make any changes to its website (including Bullion price) at any time without prior notice.
    • If there are two or more Customers:
      • you will be treated as owning the metal, and receiving the services, jointly.  If any of you die, the Property will be treated as the Property of the survivor or survivors jointly;
      • you will be jointly and severally liable to us under this Agreement.
    • You may not assign any of your rights under this Agreement.  We may assign our rights under this Agreement at any time without notice to you.
    • This Agreement is governed by the laws of Queensland.
    • No failure or delay by us in enforcing this Agreement shall amount to a waiver of any of our rights.
